GENERAL CONDITION OF SALES

These terms and conditions govern the sale and supply of products from Hot Spot Srl. The buying and selling of products and services made via the website shop.hotspotsrl.it is governed by Legislative Decree 6th September 2005/206, concerning distance selling to consumers and Legislative Decree 9th April 2003/70 on electronic commerce. HOT SPOT SRL reserves the right to change the terms and conditions of sale also comply with the new legislation on the subject. Any changes that are enforceable when they are posted on the site shop.hotspotsrl.it.

2. Purchase rules

These general conditions of sale, together with the terms of delivery and payment of goods referred to in this site are an integral part of the purchase agreement between the user of the Site (Customer) and HOT SPOT SRL. The customer who places an order on-line declares to have read and accepted unconditionally the present conditions of sale. Each different condition must be agreed from time to time in writing. To complete the purchasing please print and keep these general conditions of sale.


3. Product order

The Customer's order is deemed accepted by HOT SPOT SRL when the customer receives an order confirmation via e-mail to the address provided. The e-mail confirmation summarizes the products and services purchased by the Customer, the prices, the time and cost of delivery. The Customer undertakes to verify the correctness of the data provided and to communicate to HOT SPOT SRL, within a day of purchase, any inaccuracies. The Customer undertakes to print and retain a copy of the e-mail confirmation. After sending the reply of confirmation by HOT SPOT SRL, if HOT SPOT SRL feedback (due to errors in technical or formal) not the correct price and / or characteristics, published on the website, products and services covered by the sale, HOT SPOT SRL give express notice thereof to the Customer.

3.1. Cancellation of the order

The customer may decide to cancel the order within 24 hours after purchase by notifying HOT SPOT SRL via email to the email address pattinaggio@hotspotsrl.it or by phone at +39 (41) 445 473. You can not cancel orders containing digital download products referred to in section 6.2.

4. Customers Responsabilities

The pxurchase of products and services is intended for people of legal age or that have the capacity to act. HOT SPOT SRL declines any responsibility in case of violation of this rule. The purchase of products and services on the Site, requires the comunication about the data necessary for the delivery. For this pourpose the Customer agrees to communicate accurate and true information useful to the order. The Customer undertakes to pay the price of the goods purchased.

5. Prices and terms of payment

All prices are in Euro and include VAT.
Are outside the purchase price the additional cost of delivery, any costs of collection, customs duties and any additional charges on the sale required for export in foreign territory. Customer may provide for the payment of the amounts due by credit card or by bank transfer in advance. The digital download products can be purchased individually or together with other products, but their payment can only be made by credit card or bank transfer. In case of payment by credit card. data of the credit card will not be handled in any way by HOT SPOT SRL but directly by Banca SPA ANTONVENETA who will manage them with the utmost confidentiality. HOT SPOT SRL is not responsible for any fraudulent or illegal use that may be made by a third party credit card upon payment of the products purchased on shop.hotspotsrl.it.In this regard HOT SPOT SRL reserves the right to cancel the transaction if suspicion of fraudulent use of credit cards. Furthermore, to ensure greater security of online shopping with the use of credit cards, HOT SPOT SRL to the execution of orders may at any time request more information or documents, without which it reserves the right not to accept the transaction.

6. Shipping and delivery

HOT SPOT SRL dispatch the goods purchased by the Customer exclusively in the areas specified in the Site. Before proceeding with the purchase order, the customer is required to check whether the place of delivery within the selected List countries served. Before proceeding with the purchase order please examine the timing and costs of delivery in Italy and abroad. Delivery times are estimates based exclusively on developing normal order and the delivery times stated by the carriers. HOT SPOT SRL is not responsible for any delays caused during the transport service and ensures compliance with quality standards for products and services only up to the time of delivery at the place specified by the customer. HOT SPOT SRL is not responsable for any liability on the bad condition of the goods due to improper storage after the time of delivery. In any case, HOT SPOT SRL agrees to make delivery within thirty days of placing your order online by the customer. For the purposes of delivery  is required the presence of the customer or his representative at the place and on the day of scheduled delivery. In case of "payment at delivery", payment will not be concluded, the goods will not be delivered and HOT SPOT SRL reserves the right to terminate the contract for breach by the Client unless HOT SPOT SRL will take new agreements with the customer for a new delivery.

6.1 Physical goods

The ordinary process does not end positively in case of delivery difficulties due to wrong address. In this case the customer will be alerted to take direct contact and find an alternative way to proceed.

6.2 Digital goods

The digital content require the delivery of the goods via download or email. If the procedure of delivery (download) should not be successful due to technical problems, the customer will still have the file available purchase via email. The customer may request up to 5 times the digital content at pattinaggio@hotspotsrl.it resend or download to be made through the website.

7. Right of withdrawal

The right of withdrawal is exercised by sending to HOT SPOT SRL a letter A / R within ten working days from the date of receipt of goods. The communication can be anticipated within the same period, by e-mail or fax, provided that it is confirmed by registered A / R within 48 hours of the following references:

This shall be considered sent timely if delivered to the post office within ten working days from the date of receipt of goods.
Such notice shall clearly indicate the intention to withdraw from the purchase of products that must be identified with precision, it must be accompanied by a copy of the transport document. In the case of exercising the right of withdrawal, the customer must return the goods at their own expense sending it to the following address:

The integrity of the property to be returned must be intact and in good condition. In addition, the product must be returned in the original appliances and accessories. Failure to observe the prescribed manner will allow HOT SPOT SRL to reject the goods returned by the customer. In the event of a valid exercise of the right of withdrawal, HOT SPOT SRL will refund the purchase price and the cost of sending the goods to the customer's home as soon as possible, and no later than 30 days from the date of HOT SPOT SRL received notice of the right of withdrawal. Are excluded from the right to withdraw the costs of returning the goods, which are charged to the customer (Article 67, paragraph 3, of Legislative Decree no. N. 206/2005). In the event that the customer has received defective, damaged or wrong, delivery costs will be borne by HOT SPOT SRL that will make every diligent effort to replace the damaged or defective products. If the replacement is not possible, the only obligation of HOT SPOT SRL is to refund the amount paid. The right of withdrawal can not be exercised in the case of a) CDs, DVDs and other products delivered with seal SIAE, opened by the consumer, b) digital content purchased with download or email, see section 6.2. If the returned product defects, even minor, occurring at the time of return, HOT SPOT SRL reserves the right to reduce the value of the refund to offset the damage found on the product.
The right of withdrawal is only or the customer - consumer who buys for purposes unrelated to his economic activity and employment, and therefore provides the Supplier, together with the data, your tax code.

9. Industrial and intellectual property rights

The trademarks, other marks and other industrial property rights relating to products and services available on the Website belong to HOT SPOT SRL or third partsproducers of the goods offered for sale by HOT SPOT SRL, through this site. Use of the mark, other distinguishing marks, as well as other industrial property rights of third parties and HOT SPOT SRL is prohibited, including reproduction on other websites by unauthorized persons. The contents such as, for example, information, text, graphics and images inside the site or digital products for download are protected by copyright. The digital download products are intended for personal use only. And 'forbidden distribution, free or for sale, reproduction of the contents in any medium, modification and alteration of the content of these products.

10. Protection of personal data

The personal data provided by the Customer to HOT SPOT SRL during the pre-contract negotiations as well as the execution of the contract shall be processed pursuant to Legislative Decree no. 196/2003. With the purchase order, the customer declares to have read the Privacy policy.


11. Law and Jurisdiction

The contract of sale between HOT SPOT SRL and the Client shall be governed  in accordance with Italian law and the responsibility of the Court of Venice.
